Effective Date: April 7, 2026
By creating an account or using the Arvexa platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, do not access or use the Service.
Arvexa provides an AI-powered voice automation platform that enables businesses to deploy AI phone agents for inbound call handling and outbound calling campaigns. The Service includes voice AI agents, call transcription, campaign management, CRM tools, analytics, and related features accessible via our dashboard and API.
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You may not:
When using AI voice agents through the Service, you are responsible for:
We provide compliance tools (DNC list management, disclosure features) to assist you, but compliance with applicable laws remains your responsibility.
Fees for the Service are described on our pricing page and may vary by plan. We reserve the right to change pricing with 30 days' notice. Price changes will not apply retroactively to the current billing period.
Subscription fees are billed in advance on a monthly or annual basis depending on your plan. Usage-based charges (additional call minutes, phone number purchases) are billed as incurred.
Subscription fees are non-refundable except where required by law. Unused call minutes do not carry over between billing periods unless specified in your plan.
Certain features (such as phone number purchases) require a prepaid account balance. Balance deductions are final once the associated action is completed.
The Service, including all software, algorithms, designs, documentation, and branding, is owned by Arvexa and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited licence to use it as described herein.
You retain ownership of all content you upload, create, or transmit through the Service, including agent configurations, call scripts, CRM data, and campaign content. You grant us a limited licence to process, store, and display your content solely for the purpose of providing the Service.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual licence to use that feedback for any purpose without obligation to you.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you acknowledge that you have read and understood the Privacy Policy. Call recordings, transcripts, and related data are processed in accordance with our Privacy Policy and applicable data protection laws.
These Terms remain in effect for as long as you have an active account with us.
You may cancel your account at any time through your account settings. Cancellation takes effect at the end of the current billing period. You remain responsible for any charges incurred before cancellation.
We may suspend or terminate your account immediately if you breach these Terms, engage in prohibited use, fail to pay fees, or if required by law. We will provide notice where practicable.
Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of termination, except where retention is required by law. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will continue to apply.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED RESPONSES WILL BE ACCURATE OR APPROPRIATE FOR YOUR USE CASE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARVEXA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
You agree to indemnify, defend, and hold harmless Arvexa, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) calls made using the Service that violate applicable laws or regulations.
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for intellectual property disputes.
We may revise these Terms at any time. We will provide at least 30 days' notice of material changes by email or through the Service. Your continued use of the Service after the revised Terms take effect constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service and cancel your account.
Our Service may dispatch transactional SMS messages to end users who book appointments through our customers' AI voice agents. Messages are limited to: (1) booking confirmations sent after the appointment is scheduled, (2) appointment reminders before the scheduled time, and (3) reschedule or cancellation acknowledgements when the end user changes the booking. We do not send promotional, marketing, or solicitation content via SMS.
End users provide express verbal consent to receive SMS during the live phone call with the AI voice agent. The agent explicitly asks whether the caller is willing to receive a text message at the number they are calling from (or a number they provide). SMS is only dispatched after this verbal confirmation is captured in the call audio and transcript. As the customer (account holder), you are responsible for ensuring all SMS recipients have provided lawful consent before SMS dispatch and for complying with applicable regulations, including TCPA (United States), CASL (Canada), the Unsolicited Electronic Messages Act 2007 (New Zealand), the Spam Act 2003 (Australia), and equivalent laws in other jurisdictions.
Recipients receive a maximum of 3 messages per appointment (confirmation, reminder, and optional cancellation acknowledgement). Estimated annualised frequency: 3–12 messages per recipient per year.
Recipients can opt out at any time by replying STOP, CANCEL, END, QUIT, or UNSUBSCRIBE to any message. Opt-outs are honored immediately through our SMS provider Twilio's built-in keyword filter — no further messages will be delivered to that number. Recipients can reply HELP to receive support contact information.
Standard message and data rates from the recipient's mobile carrier may apply. Arvexa AI does not charge end users for SMS; any carrier charges are the recipient's responsibility.
We use Twilio Inc. as our SMS delivery provider. Twilio's processing of SMS-related data is governed by Twilio's privacy policy and terms of service.
For SMS-related questions, opt-out assistance, or to report an issue with messages received, contact our support team at [email protected]. Responses are provided within 1 business day.
